The Modi saga: Why was he refused recusal?

NewsX has access to the BCCI’s order on the matter, signed by the three members of the Disciplinary Committee.

The BCCI on Friday rejected Modi's demand for the recusal of Chirayu Amin and Arun Jaitley from the disciplinary panel. Both men are part of the IPL Governing Council as well.

The third member - Jyotiraditya Scindia - is perceived as neutral.

The hearing into Modi's alleged misdemeanors while being the Chairman of the Indian Premier League has pretty much been held up because of the demand from Modi's lawyers.

Now, however, NewsX has access to the BCCI’s order on the matter, signed by the three members of the Disciplinary Committee.

Explaining why Modi's demand for the recusal of the Disciplinary Committee members is not acceptable to the BCCI, the constitution is mentioned, which confirms that the BCCI has not acted in conflict of the statutes thus far.

Explaining that Modi's allegations of bias on the part of members of the Committee must be backed up by facts, the note tries to confirm that neither Amin nor Jaitley are interested or biased parties.

In the context of the termination of the TV rights contract with WSG, the note suggests that the decision is not a subject matter before the Committee.

The order also observes that any person against whom the inquiry is being conducted cannot create a situation whereby he decides who should or should not conduct the inquiry against him.

And finally, the request of Mr. Lalit K Modi for recusal of certain members of the Disciplinary Committee is rejected.

Now this is bound to lead to a fresh set of needless debates that will not serve to take the matter forward.

When the Disciplinary Committee next meets on the 18th of August in Delhi, Modi is likely to be missing again. This will logically continue till the BCCI elections in September.

The same issue of recusal is bound to crop up again and again and, with the spate of rejections and all the time taken for deliberation, it is quite likely that none of us would be any wiser for it.
